MEMBERSHIP AGREEMENT

This membership agreement is entered into between Lumoths and the user who will shop on the website www.lumoths.com (hereinafter referred to as "Member," "User," or "You"). Accordingly, you are not required to be a member to visit the Lumoths website ( www.lumoths.com ). However, you must be a member to shop on the site. As a member, you can make purchases and conduct other transactions at www.lumoths.com . By becoming a member, you consent to Lumoths accessing your personal information and processing it as described below.
If any of the terms and conditions on this page do not apply to you, please do not use www.lumoths.com . Using the site and completing the membership form, which will include your personal information, constitutes your acceptance of the terms and conditions stated on these pages.
Lumoths reserves the right to change the general and specific terms of this agreement at any time. It is important that you revisit this page when you visit www.lumoths.com to review any future changes to the membership and terms of use. It is your responsibility to review the current membership terms when using the site, and your acceptance of these terms is deemed to be your acceptance of these terms.

1. Usage and Security Rules

%sites_url is a site open to all members. Services are free for all members, except for advanced memberships or unless otherwise stated.

In the following cases, the site administration may prevent the member from using the website and reserves its legal rights against the person or persons involved in the following initiatives:

1.a. Posting on the site information that is false, irregular, incomplete and misleading, contains statements that are not in accordance with general morality, and does not comply with the laws of the Republic of Turkey.

1.b. Copying the works and content on the site partially or completely and using them or attempting to use them for different purposes.

1.c. Using software, performing activities, attempting to perform activities, and obtaining, deleting, or changing information that would threaten the general security of the site or prevent the operation of the site and the software used.

Furthermore, the MEMBER is directly responsible for any information, including usernames and passwords, provided to members or chosen by them, being shared with third parties or organizations (including any malicious use of their passwords by others). Similarly, the MEMBER may not use another person's IP address, email address, username, or other information online, nor may they access or use other users' private information without permission. All legal and criminal liability arising from such use rests with the MEMBER.

1.d. If Lumoths detects that the Member/User has misused Lumoths' campaigns, sales system or website by taking advantage of any security vulnerability of Lumoths' sales system or website, causing damage to Lumoths, gaining an unfair advantage, performing repeated practices, acting in a false manner, benefiting from these despite not meeting the conditions required by the campaign or sales conditions, Lumoths has the right to cancel the transactions in question, terminate the user's membership and unilaterally terminate the sales contract in addition to all its rights arising from the law.

1.e. Gift certificates and discounts provided to MEMBERS through www.lumoths.com cannot be sold, exchanged, shared, or transferred online except through Lumoths' own systems. Gift certificates offered for sale online by exploiting any security vulnerability on the site are invalid. You may only use one gift certificate per purchase. Lumoths may, at its sole discretion, cancel memberships created solely for the purpose of using gift certificates or discounts and/or memberships that are inactive.

2. Content Use

2.a. The visual and written content presented on www.lumoths.com is for personal use only. All rights to all text, graphics, photographs, videos, animations, and sounds contained on www.lumoths.com are reserved. Unless otherwise stated, they may not be used for commercial or personal purposes without permission and without citing the source. It is prohibited to publish any element of this site in any other media or website, or to provide a link without Lumoths' permission.

2.b. In addition, copying or using the software used in the design of these pages and the creation of the database, all rights of which belong to Lumoths, is strictly prohibited.

2.c. Lumoths is open to all kinds of criticism, comments, and feedback. The content submitted to our site is our property and may be used for marketing purposes.

3. Responsibilities

3.a. Information about users visiting www.lumoths.com is tracked to provide users with better service. The information obtained is shared with companies we collaborate with for advertising, communication, and email services, to enrich and improve our content, subject to our privacy policies. Our goal is to ensure the site meets your expectations and to ensure its continued development.

3.b. After completing the registration process and confirming the e-mail address, the www.lumoths.com member can start using the www.lumoths.com site and make purchases by entering his/her e-mail address and password, provided that he/she complies with the terms set forth in this agreement.

3.c. While using the www.lumoths.com website and services, the Member agrees to comply with the Turkish Penal Code, the Turkish Commercial Code, the Law on Intellectual and Artistic Works, the Decree Laws and legal regulations regarding the Protection of Trademark and Patent Rights, the Turkish Code of Obligations, and other relevant legislation, as well as all announcements and notifications published by www.lumoths.com regarding its services. All legal, criminal, and financial liability arising from use in violation of these notices and laws shall be the responsibility of the Member.

3.d. Due to non-compliance with the obligations set forth in this agreement or the general rules stated on the www.lumoths.com website, the Member may be temporarily or permanently prevented from using www.lumoths.com and/or his/her membership may be cancelled by Lumoths.

3.e. Members may not take any action that prevents or obstructs other members and visitors from using www.lumoths.com , or overload or lock servers or databases with automated programs. Members may not attempt to deceive or mislead users by using data. Otherwise, their membership will be terminated, and they accept all legal and criminal liability that may arise from this situation.

3.f. It is the responsibility of users to back up messages sent through www.lumoths.com and is recommended by Lumoths. Lumoths cannot be held responsible for loss, deletion, or damage to messages due to failure to back up messages.

3.g. In accordance with Copyright, Trademark and all kinds of Intellectual and Artistic Works Laws, the Member cannot delete or remove his/her notes from any material copied or printed from www.lumoths.com .

3.h. Membership cancellation and account deletion are performed by Lumoths upon the member's request. Upon termination of membership, the user's access to the site will be revoked. By canceling their membership, the user acknowledges that this process is irreversible.

3.i. Lumoths reserves the right to delete or not delete any records from a member account terminated by Lumoths or the member themselves. The member cannot claim any rights or compensation for deleted records. In this case, Lumoths will not be liable for personal data shared with third parties pursuant to the approvals it has obtained for the use of personal information or the permissions it has obtained.

3.j. The relationships between members of the site and each other or third parties are the responsibility of the members themselves.

3.k. At the same time, the possible risks related to the links (links to different websites) included on this site for the purpose of providing information and convenience to visitors are the responsibility of the visitors.

3.l. Different rules and obligations specific to that section may be specified in certain areas of the site. Individuals and organizations using these sections are deemed to have accepted the relevant rules and obligations in advance.

The MEMBER agrees that, from the moment they begin using the Service, they will be deemed to have accepted all the provisions of this participation agreement and that this agreement will be binding on them. The MEMBER will compensate Lumoths in kind for any damages they may incur due to their breach of obligations under this agreement. Lumoths has the right to recourse against the MEMBER for any compensation and/or administrative/judicial fines they may be required to pay to public institutions and/or third parties due to the MEMBER's breach of this agreement.

4. Lumoths' Rights and Obligations

4.a. www.lumoths.com accepts and undertakes that the member will benefit from the services covered by the contract, excluding technical malfunctions.

4.b. Lumoths may unilaterally amend this agreement without notice to ensure the continuity of its services, to comply with legislation, or due to technical or other needs. Lumoths reserves the right to unilaterally suspend the service, permanently or temporarily, and to change or cancel the service content at any time, without justification. The Member accepts this right in advance. Lumoths will publish the updated terms of use on its website under the same link with the new date, and if deemed necessary, the Member will be notified by email. The updated terms of use will be effective from the moment they are published on www.lumoths.com , and the use of the www.lumoths.com website or services will be subject to the updated terms of use from that moment on. Members who do not accept the changes may notify Lumoths of their termination of this membership agreement by emailing %sites_mail%.

The membership of a member who has sent materials to www.lumoths.com that violate the provisions of this agreement may be terminated unilaterally by Lumoths without any notice.

4.c. Lumoths has the right to use all information related to your membership for various marketing activities and for the reasons listed below, provided that it complies with the terms of use, privacy principles and applicable legal regulations.

By reading and accepting these terms of membership and use, the Member/User shall be deemed to have consented to all commercial electronic messages sent to them by Lumoths, companies belonging to Lumoths and/or affiliated with Lumoths and/or affiliated with Lumoths and/or affiliated with the group to which Lumoths is affiliated, and/or affiliated with companies affiliated with the group, Lumoths' suppliers, and/or companies with which Lumoths has commercial relations. In this context, the Member/User agrees that Lumoths may send them electronic messages, product samples, catalogs, and advertising materials for informational, marketing, and/or advertising purposes without obtaining any prior consent from the Member/User, via automatic dialing systems such as fax, email, text messaging, or other means of communication that operate without human intervention. In case of transfer of Lumoths or www.lumoths.com domain name or Lumoths brand, Member/User accepts that this permission will also apply to the persons who transfer the Lumoths business or brand or domain name.

You agree that Lumoths may collect, process and store the following personal information of yours:

Email address, address/contact information, identification number, financial information,

Information regarding the transactions made based on your activities on the site,

Shipping, billing information or other information provided to purchase or ship a product,

Correspondence, feedback and messages sent to www.lumoths.com through the site,

Other information arising from your visit to the website, your use of www.lumoths.com services, your interaction with our content and advertisements, including computer/hardware and connection information, page view statistics, traffic information to and from the page, ad data/data related to advertising, IP addresses and standard web log information/standard web log information.

Information received from other companies, such as demographic and navigation data, and;

Additional information provided by third parties.

Lumoths may use the data it collects and share it with third parties for the following purposes:

Providing user support and services for the smooth operation of sales processes,

Resolving disputes and problems on the site,

To prevent, detect and investigate illegal activities and enforce www.lumoths.com User Agreement,

To personalize, measure and improve our services, content and promotions

To provide you with information about targeted marketing, service updates and promotional offers through communication channels with Lumoths and companies that belong to Lumoths and/or are affiliated with Lumoths and/or are affiliated with Lumoths and/or are affiliated with the group of companies to which Lumoths is affiliated and/or are affiliated with the companies affiliated with the group, Lumoths' suppliers and/or companies with which Lumoths has commercial relations,

Sending marketing promotions via email as defined in this agreement,

To compare information to verify its accuracy and to verify this information with third parties, and

To use it for any activity that may be carried out within the scope of various service or marketing activities.

You consent to Lumoths sharing your personal information with the following third parties:

Service providers who assist Lumoths in carrying out its business activities within the framework of contracts,

Companies that belong to Lumoths and/or are affiliated with Lumoths and/or are affiliated with Lumoths and/or are affiliated with the group of companies to which Lumoths is affiliated and/or are affiliated with the companies affiliated with the group, Lumoths' suppliers and/or companies with which Lumoths has commercial relations.

Judicial authorities or other government agencies or third parties requesting information regarding an investigation, illegal activity or other activities that could lead to civil or criminal liability of Lumoths, you or other www.lumoths.com users, and other persons or commercial organizations considering acquiring or merging with Lumoths, its domain name or trademark.

Members/Users may opt out of receiving electronic messages covered by these Terms of Use at any time and without specifying any reason. Simply submit your request to www.lumoths.com using the contact information provided in the call or message. Lumoths will ensure that the opt-out request is easily communicated to them free of charge and will comply with the request within three (3) days of receipt. To opt out of emails received from other websites or third parties subject to the permission granted under this Agreement, the same procedure as described on the other websites or as defined by these third parties must be followed.

Members/users may request written information, free of charge, to learn what information is stored about them at www.lumoths.com . Requests for correction, blocking, or deletion of information are processed promptly to the extent required by law. 5. Use of Cookies

You consent to the use of cookies used by www.lumoths.com to identify you and keep you logged in. These cookies, called "session cookies," are automatically deleted from your hard drive when you log out.

You may also encounter third-party cookies on certain pages of the site and outside of our control.

6. Entry into Force of the Agreement

Upon registration, the Member is deemed to have accepted the terms and conditions set forth in this Agreement and this Agreement is effective. This Agreement will automatically terminate upon termination of membership or upon the occurrence of any of the termination conditions specified in this Agreement, without the need for any notice.

7. Competent Court and Dispute Resolution

Istanbul Courts and Enforcement Offices are authorized to resolve disputes that may arise from the implementation of this agreement.

8. Notification Addresses

8.a. The www.lumoths.com website does not request members' mailing addresses in advance. However, the email address provided by the member to www.lumoths.com will be deemed the legal address for all notifications related to this agreement.

8.b. The parties agree that unless they notify the other party in writing of any changes to their current e-mail addresses within 3 (three) days, requests made to old e-mail addresses will be valid and will be deemed to have been made to them.

8.c. Any notification sent by Lumoths using the member's registered email address will be deemed to have reached the member one (1) day after the email is sent. The MEMBER declares, acknowledges, and undertakes that they have read, understood, and accepted all of the terms and conditions of this membership agreement and confirm the accuracy of the information they have provided regarding themselves.
